TSA's authority to order air carriers to deny boarding to individuals posing a threat to passengers is well established and clear. TSA leadership was well aware of this authority when coordinating with the CDC on May 24.
TSA exercised this authority within minutes of CDC's request for assistance. The subsequent interval in getting the directive to air carriers involved determinations by other government agencies. In addition, by the time the CDC provided Mr. Speaker's identity to TSA, he already had landed in Montreal.
